Terms of Service

1. Scope

These Terms of Service apply to all contracts between ION Solutions GmbH (hereinafter “Provider”) and the customer regarding the use of the online service PassphotoLabs (hereinafter “Service”).

2. Subject of Contract

The Provider offers an AI-powered online service for the creation and validation of biometric passport photos. The Service includes:

  • Creation of biometric passport photos from uploaded photos
  • Validation of existing photos for biometric compliance
  • Provision of print-ready files for download

3. Contract Formation

The contract is formed by the customer’s order and acceptance by the Provider. Acceptance occurs through the provision of the Service.

4. Prices and Payment

  • Current prices can be viewed on the website
  • All prices include statutory VAT
  • Payment is made in advance via the offered payment methods

5. Service Description

5.1 Create Passport Photo

The Service creates a biometric passport photo from a photo uploaded by the customer. Processing includes:

  • Background removal and replacement
  • Biometric cropping and alignment
  • Verification of biometric requirements
  • Color corrections and exposure adjustments

5.2 Validate Passport Photo

The Service checks a photo uploaded by the customer for compliance with biometric requirements and generates a validation report.

5.3 No Guarantee of Authority Acceptance

While we achieve a 98% acceptance rate, the Provider cannot provide an absolute guarantee that the photo will be accepted by all authorities worldwide.

6. Money-Back Guarantee

If a photo created with PassphotoLabs is rejected by an authority in Austria, Germany or Switzerland, the Provider will refund the full purchase price. Requirements:

  • The photo was submitted unchanged and in the provided file format
  • The rejection is documented by written proof from the authority
  • The refund request is made within 30 days of the rejection

7. Right of Withdrawal

As a consumer, you have a 14-day right of withdrawal. The right of withdrawal expires once the Service has been fully provided and you have expressly agreed before the provision that the Provider may begin providing the service.

8. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy and in compliance with the GDPR. For more information, please visit /privacy-policy/.

9. Limitation of Liability

  • The Provider is fully liable for intent and gross negligence
  • In case of slight negligence, the Provider is only liable for breach of essential contractual obligations
  • Liability is limited to foreseeable, contract-typical damages
  • Liability for data loss is limited to typical restoration costs

10. Intellectual Property

  • The customer retains all rights to the uploaded original photos
  • The Provider receives a time-limited right of use for the provision of the service
  • The software and algorithms of the Service remain the intellectual property of the Provider

11. Availability

The Provider strives for a Service availability of 99.5%. Maintenance work will be announced in advance where possible. There is no entitlement to uninterrupted availability.

12. Changes to Terms

The Provider reserves the right to modify these Terms. Changes will be communicated to the customer by email or on the website. Changes are deemed approved if the customer does not object within 14 days.

13. Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, Austria.

14. Final Provisions

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose.
